Empresa Digital is operated by YA Desenvolvimento de Softwares Ltda. These Terms of Use govern access to and use of the business-management software made available at http://empresadigital.io, on Apple's App Store, and on the Google Play Store, designed to help micro-enterprises and small businesses manage their operations and interactions with end customers.

1. Terms

By accessing the http://empresadigital.io website, the App Store, or the Google Play Store, or by using the software, you agree to be bound by these Terms of Use and all applicable laws and regulations, including the Brazilian General Data Protection Law (LGPD - Law No. 13.709/2018), and you assume responsibility for compliance with any applicable local laws.

If you do not agree with these terms, you are prohibited from using or accessing the website, the App Store, the Google Play Store, and the software. The materials and software contained on this website and on the distribution platforms are protected by applicable copyright and trademark law.

2. Use License

A non-exclusive license is granted to access and use the software solely online, through browsers, the App Store, or the Google Play Store, for the purposes of a company's internal management or interaction as an end customer.

This license does not transfer ownership, and you may not: modify, copy, or attempt to access the software's source code; use the software for resale, sublicensing, or any commercial exploitation that generates direct profit from the tool itself; attempt to decompile, reverse-engineer, or improperly access any part of the software; remove copyright or other proprietary notices displayed in the software or related materials; or transfer access to the software to third parties or "mirror" the software on other servers or platforms.

This license terminates automatically if you violate these restrictions and may be terminated by YA Desenvolvimento de Softwares Ltda at any time. Upon termination of authorized use or of the license, you must immediately cease accessing the software.

3. Complementary Equipment and Devices

Use of the software may require complementary equipment such as computers, mobile devices, or NFC/QR Code devices for access to digital catalogs. Acquiring, maintaining, and ensuring the compatibility of such equipment is the user's sole responsibility. YA Desenvolvimento de Softwares Ltda does not provide, warrant, or take responsibility for damages, failures, or interruptions arising from the inadequacy, malfunction, or incompatibility of equipment.

4. Disclaimer

The software and the materials on the http://empresadigital.io website, the App Store, and the Google Play Store are provided "as is". YA Desenvolvimento de Softwares Ltda makes no warranties, express or implied, and disclaims all warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, except in cases of willful misconduct or gross negligence, as provided by applicable law.

YA Desenvolvimento de Softwares Ltda does not warrant the accuracy, likely results, or reliability of the use of the software or of materials on any linked sites.

5. Limitations

YA Desenvolvimento de Softwares Ltda and its suppliers shall not be liable for any damages (including, without limitation, loss of data, profits, or business interruption) arising from the use of or inability to use the software, even if notified of the possibility of such damages, except in cases of willful misconduct or gross negligence, as provided by applicable law.

6. Service Availability

The software is hosted on the Bubble.io platform, and its availability depends on third-party infrastructure. YA Desenvolvimento de Softwares Ltda will make commercially reasonable efforts to ensure continuous access but is not responsible for interruptions due to maintenance, technical failures, or events beyond its control. 7. Plans and Payments

Some software features, such as the point of sale, are available only on paid plans. Details on pricing, payment methods, cancellation, and refunds are available at http://empresadigital.io/planos.

Payments may be made via In-App Purchases (IAP) in the apps (App Store or Google Play) or through external gateways where permitted (e.g., on the website or via alternative methods in authorized regions). Consult the App Store and Google Play guidelines for regions where alternative methods are permitted.

Purchases made outside the app (e.g., on the website) may be synchronized for use in the app upon logging into the user's account.

For alternative in-app payment methods, where available, you may choose between the store's payment system (IAP or Google Play Billing) or external gateways, as permitted by the App Store and Google Play guidelines.

8. Accuracy of Materials

The materials on the http://empresadigital.io website, the App Store, and the Google Play Store may contain technical, typographical, or photographic errors. YA Desenvolvimento de Softwares Ltda does not warrant that the materials are accurate, complete, or current, and may change them at any time without prior notice, with no commitment to update them.

YA Desenvolvimento de Softwares Ltda has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement. Use of any linked site is at your own risk.

These Terms of Use are governed by the laws of Brazil, with the courts of Belo Horizonte, Minas Gerais, having exclusive jurisdiction over any disputes.

15. Third-Party Intellectual Property

The app uses third-party services (e.g., Google Maps, email services, payment services, artificial-intelligence tools) under authorized terms. By enabling integrations, you agree to the terms of those services.
